points based system

In March 2008 the government introduced the Points Based System. This saw the biggest overhaul of the Immigration system in the UK for over 45 years. There are 5 main tiers under which people applying to come to the UK to work or study can be categorised.  Points are awarded under these tiers to reflect an applicant’s aptitude, experience and age.

DBS Law is well versed on the points based system and is able to assist you throughout the whole process. The key categories under the Points Based System include:

Tier 1 (General)

This category for those that are highly skilled and can bring their qualifications and experience to the UK. If your application is successful then you will be entitled to live and work in the UK without any restrictions.  The benefit of applying under this tier is that you do not have to have a prior offer of employment.

Tier 1 (Post study Worker)

This category is for the international students who have completed their studies in the UK.  If your application is successful then it will allow you to gain work experience in the UK over a period of two years.

Tier 2 (General)

This category is for skilled workers from outside the EEA and replaces the old system of a work permit. If you are applying under this tier you will be required to hold an offer of employment. This means that you will need to obtain a certificate of sponsorship from your employer. Therefore, your employer must be a licensed sponsor with the UK Border Agency.

Tier 2 (Minister of Religion)

This category allows religious workers who want to come to the UK with the intention of preaching to the community and/or pastoral duties to do so.

Tier 2 (Sports Persons)

This category is for elite sports persons or coaches who want to come to the UK. You qualify under this tier you will have to be established at the highest level internationally.  Also, your employment in the UK will need to be such that will generate a significant contribution to the development of your sport at the highest level

Tier 4 (Students)

This category allows students from abroad to come and study in the UK. If you are applying under this tier you will require a certificate of sponsorship from the college/university that you have been accepted at. You will be granted leave to remain in the UK for the duration of your course.

Tier 5 (Temporary Workers)

This category allows a range of different workers to come to the UK on a temporary basis. This includes musicians, sports personalities, religious workers etc. The maximum duration of leave you will be granted is 24 months and switching to other tiers will not be permitted.
